These Terms & Conditions apply to the use of the facilities and services provided by ITH Living LLP, which operates under the brand name ITH Stays, at its properties including hostels, homes, cottages, villas, havelis, vacation rentals, and other accommodation types (collectively referred to as “ITH Properties”) by its customers and guests.
A. Brand & Ownership Context
“ITH” originally stood for International Travellers’ Hostel, the founding property of the brand. Over time, ITH Stays evolved as the customer-facing brand encompassing multiple hospitality establishments owned, managed, franchised, or operated under the umbrella of ITH Living LLP, a company registered in the Republic of India.
Each ITH Property may be owned and operated by individual proprietors, trusts, or other legal entities under various management formats (including franchise, management, or affiliate arrangements). All properties collectively form the ITH Stays network (“ITH”, “ITH Stays”, “we”, “our”, “us”).
B. Maya – ITH AI Concierge
ITH provides an artificial-intelligence assistant named Maya (“ITH AI Concierge”) to assist guests and users with general information about properties, facilities, and experiences.
While every effort is made to ensure accuracy, Maya may occasionally provide incomplete, outdated, or inaccurate information. Responses generated by Maya—whether on our website, WhatsApp, Instagram, Facebook Messenger, or any other digital or third-party platform—are offered for informational purposes only and do not constitute binding advice, confirmation, or contractual terms.
In the event of any inconsistency or dispute between information provided by Maya (or any automated digital communication) and information provided by a human representative of ITH Living LLP or an authorised property operator, the human-provided information shall prevail.
ITH Living LLP, its affiliates, franchisees, property owners, and partners shall not be held liable for any loss, misunderstanding, or reliance arising from the use of Maya or any other automated system. Guests are encouraged to verify all important details directly with the ITH team (official employees of ITH Living LLP) or with the authorised staff employed directly by the respective ITH property via hello@ithstays.com or +91-542-2220058 before making any decision or payment.
Use of Maya or any other digital interaction with ITH constitutes acceptance of this disclaimer.
C. Scope of Terms
These Terms & Conditions govern the use of all properties and services under the ITH Stays brand, including hostels, havelis, homes, cottages, villas, and other vacation rentals operated by ITH Living LLP or its affiliates, franchisees, or partners.
1. Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:
“Customer” means a paying guest of an ITH Property;
“OTA” means Online Travel Agents including, but not limited to, Hostelworld.com, Booking.com, Agoda.com, MakeMyTrip.com, Goibibo.com or Airbnb.com; and
“ITH Property” or “Property” means any accommodation or hospitality establishment owned, managed, franchised, or operated under the ITH Stays brand by ITH Living LLP or its affiliates; and
“Rates” means the prices payable for rooms and (where applicable) other facilities offered by an ITH Property.
1.2 Unless the context otherwise requires, each reference in these Terms and Conditions to:
1.2.1 “these Terms and Conditions” is a reference to these Terms and each of the Schedules as amended or supplemented at the relevant time;
1.2.2 a Clause or sub-Clause is a reference to a Clause of these Terms;
1.3 The headings used in these Terms are for convenience only and shall have no effect upon interpretation.
1.4 Words imparting the singular shall include the plural and vice versa.
1.5 References to any gender shall include the other gender.
2. Bookings and Reservations
2.1 Customers may make reservations in advance through the ITH website, OTAs, telephone, and in person.
2.2 When making reservations, Customers will be required to provide identification information including, but not limited to, their name, address, contact telephone number, nationality, and e-mail address.
2.3 Payment details will be required for all reservations. Unless the reservation is expressly stated to require payment at the time of reservation, no payment will be taken until such times as indicated in Clause 3 below.
2.4 Reservations booked in advance do not constitute a legally binding contract between the Property and the Customer until the Property confirms the reservation with the Customer and provides the Customer with a booking reference.
2.5 Reservations may be changed by the Customer at any time prior to arrival (subject to the cancellation provisions set out in Clause 4 below). The Property will use all reasonable endeavours to accommodate any changes requested but gives no guarantee that all changes will be accommodated.
2.6 Reservations are not required – Customers may make bookings on arrival. However, the Property cannot guarantee the availability of rooms or other facilities for such bookings.
2.7 Customers may request additional nights at the Property at any time during their stay. The Property will use all reasonable endeavours to accommodate such requests.
3. Fees and Payment
3.1 Details of Rates including, where applicable, promotional Rates and other special offers are available from the ITH website.
3.2 Rates and prices quoted when making reservations apply only to accommodation unless otherwise stated. Additional charges may apply for items including, but not limited to, meals, room service and wireless internet access. Customers will be informed of the prices payable for such additional items on arrival.
3.3 Subject to sub-Clause 3.4 below, Customers shall pay all sums due upon checking-in at the Property. Payment shall be against an Invoice/Cash Receipt and must be made immediately, subject to any alternative agreement between the Property and the Customer.
3.4 The Property may from time to time offer promotional Rates. The following provisions apply:
3.4.1 Unless expressly stated otherwise, all reservations to which promotional Rates apply must be paid in full at the time of booking;
3.4.2 Additional charges incurred by the Customer during their stay will be invoiced and payable in accordance with sub-Clause 3.3 above; and
3.4.3 Additional nights requested under sub-Clause 2.7 above shall be charged at the standard Rate.
3.5 Advance payments made under sub-Clause 3.4 above are non-refundable.
3.6 Any deposits or booking fees taken at the time of reservation are non-refundable unless expressly stated by the Property, in which case such deposits may be partially refundable subject to sub-Clause 4.3 below.
3.7 The Property may, from time to time, require a security deposit to confirm a booking. The security deposit is fully refundable subject to the provisions of sub-Clause 6.10 below.
3.8 The Property may offer certain free services (e.g. Airport Transfer, City Transfer, Wi-Fi, Breakfast, etc.) as part of a ‘Booking Package’. In case of modification of the package from its original form such that the duration of stay is cut short or cancelled, the free services thus offered shall become void immediately and the Customer will be required to pay for services already consumed.
3.9 The following payment methods are accepted:
3.9.1 Online Payment Gateways (AirPay, Razorpay, and PayPal);
3.9.2 Wire Transfer (Western Union, TransferWise, etc.) / Bank Transfer (BACS, NEFT, IMPS, etc.);
3.9.3 Select domestic & international Debit & Credit cards;
3.9.4 UPI;
3.9.5 Cash.
3.10 The Property reserves the right to charge the Customer’s payment method (typically a credit or debit card) using online or offline payment technologies under the provisions of the booking policy.
4. Cancellations and Modifications
4.1 Subject to sub-Clause 4.2 below, reservations made directly with ITH Stays may be cancelled or modified free of charge provided the Customer gives at least one (1) day’s notice before the scheduled check-in time. Subject to Clauses 3.6, 4.3 and 4.7, any sums paid in advance shall be refunded to the Customer to the original payment method. ITH Stays follows a no-questions-asked refund policy for cancellations made within the free-cancellation period.
4.2 Reservations made through Online Travel Agents (OTAs) may be cancelled or modified free of charge up to five (5) days before the scheduled check-in time, in accordance with the booking policy displayed on the OTA at the time of reservation.
4.3 After the time periods stated in sub-Clauses 4.1 and 4.2, or for bookings made under non-refundable or promotional rates, no cancellation or modification is permitted, and the Customer shall be charged the full amount of the stay.
4.3.1 The above restriction also applies to partial modifications such as date changes, shortening of stay, or change of room type.
4.3.2 All such requests, if exceptionally approved at the Property’s discretion, shall be treated as a new reservation and charged at the prevailing Rate.
4.3.3 Any payments already made shall not be refunded or transferred to another booking.
4.4 Failure to provide the required notice of cancellation or modification shall result in the Customer being charged for the entire amount of the stay at the Rate specified in the reservation.
4.4.1 Failure to provide such notice shall also result in subsequent nights, if any, being automatically cancelled.
4.5 The Property may, at its discretion, cancel or modify a reservation in exceptional circumstances. In such cases, the Customer will be informed immediately and offered a full refund of any sums paid.
4.6 Continuous bookings exceeding 180 consecutive days may be cancelled by the Property.
4.7 Any processing fees, currency-conversion charges, or gateway commissions applied by payment processors (e.g. AirPay, PayPal, banks) are borne by the Customer and are non-refundable.
4.8 Bookings made through OTAs such as Booking.com, Agoda.com, MakeMyTrip.com, Goibibo.com, Hostelworld.com, or Airbnb.com are governed by the respective OTA’s cancellation and modification policies as displayed on their platforms.
4.9 Reservations made through any OTA are governed entirely by that OTA’s terms and conditions. All cancellation, modification, and refund requests must be submitted directly to the OTA used to make the booking. ITH Stays, ITH Living LLP, and all affiliated Properties will not accept, process, or be responsible for any such requests. All payments, refunds, and modifications are administered solely by the OTA, and ITH Stays and its Properties disclaim any and all liability for delays, denials, errors, or losses arising from the OTA’s actions, omissions, or policies.
5. Check-in and Check-out
5.1 Standard check-in time at all ITH Properties is 12:00 pm, except for the Luxury Cottage – Hibiscus, where check-in time is 3:00 pm.
Guests arriving earlier than the standard check-in time may be accommodated subject to room availability.
At the International Travellers’ Hostel, direct bookers are entitled to free early check-in from 9:00 am (subject to availability) and a Free Light Breakfast.
These offers and the 1-day free-cancellation policy for direct bookers may be amended or withdrawn at any time without prior notice.
5.2 Check-out time at all ITH Properties is 11:00 am. Later check-outs may be possible by prior arrangement (and at the Property’s discretion); otherwise, failure to check out on time may result in an additional night’s charge.
5.3 In the event of a pre-arranged late check-out under sub-Clause 5.2 above, the Property shall charge an hourly rate as advised upon request.
6. Property Rules (House Rules)
6.1 The term “Property Rules” applies to all ITH Properties regardless of type.
6.2 Valid photo identification is required at check-in. Passport is mandatory for all non-Indian nationals.
6.3 Customers are required to conduct themselves reasonably and responsibly at all times and must not act in any way which may disturb other guests. Failure to do so may result in removal without refund.
6.4 Smoking is not permitted in any indoor public areas.
6.5 Smoking is not permitted in any rooms.
6.6 Failure to adhere to sub-Clause 6.4 shall result in a cleaning charge to restore the room to a smoke-free condition.
6.7 Pet animals may be permitted at the Property’s discretion.
6.8 Children under 18 may not stay unless accompanied by an adult aged at least 18.
6.9 Children under 18 are allowed only in private rooms or dormitories booked for the exclusive use of one family or group.
6.10 Customers shall be charged for any and all damages caused by them to any Property asset during their stay.
7. Food and Drink
7.1 Unless expressly indicated otherwise, food and drinks are not included in any Rates.
7.2 Customers with special dietary requirements should inform the Property in advance.
7.3 Meal times will be informed upon arrival.
7.4 Bringing meat, fish, or egg into the Property is prohibited.
7.5 Plastic bottles brought in by the Customer must be carried out; leaving such waste is not permitted.
8. Disabled Customers
8.1 Due to uneven floors and architectural layouts, not all ITH Properties can accommodate guests with certain physical disabilities.
8.2 Customers with special requirements should inform the Property in advance.
9. Limitation of Liability
9.1 To the fullest extent permissible by law, ITH Living LLP, its affiliates, franchisees, and individual property owners shall not be liable for any loss or damage suffered by Customers except where such loss or damage arises directly out of the proven negligence or wilful misconduct of ITH or its authorised employees.
9.2 Notwithstanding sub-Clause 9.1 above, ITH Living LLP and its affiliates shall not be liable for any indirect, incidental, or consequential loss including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data, or loss of enjoyment.
9.3 Nothing in these Terms and Conditions shall be construed as expanding ITH’s liability beyond that required by law. Without prejudice to the generality of the foregoing:
9.3.1 ITH shall not be liable for death or personal injury except to the minimum extent required under applicable Indian law and only where such injury is directly caused by gross negligence of ITH’s authorised employees acting within the scope of their employment;
9.3.2 ITH shall not be liable for any loss, damage, or inconvenience arising from force majeure events, acts of God, power failures, natural calamities, civil disturbances, pandemics, government orders, or any similar circumstances beyond its reasonable control; and
9.3.3 ITH shall not be liable for any inaccurate information provided by third parties, including OTAs, digital platforms, or automated systems such as Maya (ITH AI Concierge).
10. General
10.1 The Customer’s rights under consumer protection legislation remain unaffected.
10.2 ITH may change these Terms from time to time without notice but will endeavour to inform Customers as soon as reasonably possible.
11. Data Protection
ITH and its affiliates will not share Customers’ personal data with any third parties without prior consent. Data will be processed in accordance with the Personal Data (Protection) Act, 2013 and the Information Technology (Amendment) Act, 2008.
12. No Waiver
No failure by ITH to enforce any provision shall constitute a waiver of its rights to enforce that or any other provision later.
13. Severance
If any provision is held invalid or unenforceable in whole or in part, the validity of the other provisions shall not be affected.
14. Law and Jurisdiction
14.1 These Terms (including any non-contractual matters) shall be governed by the laws of the Republic of India.
14.2 Any dispute, controversy, or claim shall fall within the jurisdiction of the courts of Varanasi, Uttar Pradesh, India.
14.3 For guests residing or booking from outside India, local consumer-protection laws may additionally apply to the extent required by law.
15. Artificial Intelligence, Social Media & Digital Communications
ITH Living LLP and its affiliated or partner properties may use artificial-intelligence systems, chatbots, and third-party messaging platforms (including WhatsApp, Instagram, Facebook Messenger, and e-mail automation) to assist guests.
Such communications are provided solely for convenience and do not constitute binding representations or offers unless expressly confirmed in writing by an authorised member of the ITH team or the relevant Property’s authorised staff.
By engaging with these channels, the user acknowledges and accepts that automated responses are informational only and that any legally enforceable commitment must originate from a human representative of ITH Living LLP or the respective Property.
